1. Acceptance of Terms
By creating an account, accessing, or using the Sift platform ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use the Service.
We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on the Service at least 30 days before changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and may delete your account.
2. Service Description
Sift is an AI-powered lead qualification platform designed for real estate agencies and professionals. The Service provides:
- AI Conversations: Automated lead qualification through natural language conversations via web widget and WhatsApp.
- Property Management: Upload and manage property listings via Excel/CSV files and automated web scraping.
- Lead Management: Tracking, scoring, and exporting qualified leads with conversation history.
- Calendar & Scheduling: Availability management, appointment booking, and ICS export/import.
- Analytics: Conversation metrics, lead scoring analytics, and usage reporting.
- WhatsApp Integration: Connect your WhatsApp Business number for lead qualification on WhatsApp (available on Standard and Pro plans).
- API Access: Programmatic access to the platform for custom integrations (Pro plan only).

3. Account Terms
- You must be at least 18 years of age to create an account and use the Service.
- You must provide a valid email address and accurate information when creating an account.
- You are responsible for maintaining the confidentiality and security of your account credentials.
- You are responsible for all activities that occur under your account, whether or not authorized by you.
- You must notify us immediately at security@sift.software if you become aware of any unauthorized access to your account.
- One person or organization may not maintain more than one free account.
- You may not use the Service if you have been previously banned or had your account terminated for violating these Terms.
- Account sharing is not permitted. Each user should have their own account credentials.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose that violates applicable local, national, or international laws or regulations.
- Upload or transmit malicious code, viruses, malware, or other harmful content.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Use the AI agent to generate misleading, deceptive, fraudulent, or spam content.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Interfere with, disrupt, or overload the Service or its infrastructure.
- Scrape, crawl, or otherwise extract data from the Service itself (your own data export is permitted).
- Resell, sublicense, or redistribute the Service or any part thereof without our written consent.
- Use the Service to harass, abuse, stalk, threaten, or intimidate any person.
- Circumvent usage limits, billing systems, or access controls.
- Use automated tools to create accounts or interact with the Service beyond what the API explicitly allows.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending or terminating accounts, and reporting to law enforcement.
5. Billing & Payments
5.1 Plans & Pricing
- Free Plan: Available at no cost with limited features, 50 messages/month, and 1 MB storage.
- Standard Plan: $50/month or $500/year. Includes 2,000 messages/month, 25 MB storage, WhatsApp integration, custom prompts, and lead export.
- Pro Plan: $150/month or $1,500/year. Includes 10,000 messages/month, 50 MB storage, API access, auto scraping, and everything in Standard.
Prices are in US dollars. We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing period.
5.2 Payment Processing
Payments are processed by Paddle (paddle.com), our authorized reseller and Merchant of Record. Paddle handles all payment processing, tax compliance, and billing on our behalf. By subscribing to a paid plan, you agree to Paddle's Terms of Service. We do not store credit card numbers or bank account details — all payment data is held by Paddle.
5.3 Message Packs & Add-Ons
- Message Packs: One-time purchases of 1,000 messages ($15) or 2,000 messages ($20). Purchased messages do not expire and are non-refundable.
- Auto-Recharge: When enabled, 2,000 messages are automatically purchased for $20 when your balance falls below your configured threshold. You can disable auto-recharge at any time.
- Remove Branding: $150/month to remove "Powered by Sift" from your chat widget.
5.4 Cancellation & Refunds
- You may cancel your subscription at any time from the Billing page or Settings.
- Cancellation takes effect at the end of your current billing period. You retain full access until then.
- After cancellation, your account reverts to the Free plan with its corresponding limits.
- Purchased message packs are non-refundable but remain available on the Free plan.
Refund Policy
We offer a 14-day refund window on your first subscription payment only, subject to the usage conditions below. Renewal payments and subsequent billing cycles are non-refundable.

Full refund — if you request a refund within 14 days of your first payment and your cumulative message usage has not exceeded 2% of your plan's monthly message allowance (40 messages on Standard; 200 messages on Pro), you are entitled to a full refund of the subscription fee paid.

Partial refund — if your usage exceeds 2% of your plan allowance within the 14-day window, we will issue a refund equal to the subscription fee paid minus the cost of messages consumed. Consumed messages are valued at the per-message rate of your plan ($0.025/message on Standard; $0.015/message on Pro).

No refund — refund requests submitted after 14 days from the date of first payment will not be accepted. No partial refunds are provided for unused portions of any subsequent billing period.
To request a refund, email billing@sift.software with your account email and reason for cancellation within the 14-day window. Approved refunds are processed through Paddle and may take 5–10 business days to appear on your statement.
5.5 Overdue Payments
If a payment fails, we will attempt to process it again. If payment remains unsuccessful after 7 days, we may downgrade your account to the Free plan. We will notify you by email before any downgrade.
6. Your Data & Content
- You retain full ownership of all data you upload or create through the Service, including property listings, lead information, chat conversations, company documents, and agent configurations.
- You grant us a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing and improving the Service.
- We do not claim ownership of your content and will not use your data for purposes unrelated to the Service.
- You are responsible for ensuring you have the right to upload any content you provide to the Service.
- Our handling of your data is governed by our Privacy Policy, which forms part of these Terms.
7. AI-Generated Content
- The Service uses AI language models (OpenAI) to generate conversational responses, lead scores, property recommendations, and conversation summaries.
- AI-generated content is provided for informational and lead qualification purposes only. It does not constitute professional advice (legal, financial, real estate, or otherwise).
- While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information.
- You are solely responsible for reviewing, verifying, and approving all information communicated to leads by the AI agent.
- We are not liable for any decisions made or actions taken by you, your team, or your leads based on AI-generated content.
- You acknowledge that AI responses may vary and are not guaranteed to be consistent across similar queries.
- We do not use your data to train or fine-tune AI models.
8. Intellectual Property
- The Service, including its design, code, features, documentation, algorithms, and user interface, is owned by Sift and protected by intellectual property laws.
- "Sift" and the Sift logo are trademarks of SIGNATURE GROUP DANIŞMANLIK HİZMETLERİ VE GENEL TİCARET LİMİTED ŞİRKETİ. You may not use our trademarks without prior written permission.
- You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of any part of the Service.
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms for the duration of your subscription.
- Feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.
9. Third-Party Services
The Service integrates with and relies on third-party providers. Your use of these integrations is subject to the respective third party's terms:
We are not responsible for the availability, reliability, accuracy, or policies of third-party services. Outages or changes in third-party services may temporarily affect the functionality of the Service.
10. Service Availability & Support
- We aim to maintain high availability of the Service but do not guarantee 100% uptime.
- We may perform scheduled maintenance that temporarily affects availability. We will provide reasonable notice when possible.
- Emergency maintenance may occur without prior notice to address security or stability issues.
- Support is provided via email. Pro plan customers receive priority support with faster response times.
- We may modify, update, or discontinue features of the Service at any time, with reasonable notice for material changes.
11. Termination
11.1 Termination by You
You may delete your account at any time from the Settings > Danger Zone page. Account deletion permanently removes all your data, including organization records, leads, conversations, properties, appointments, and configuration. This action is irreversible. We recommend exporting your data before deletion.
11.2 Termination by Us
We may suspend or terminate your account, with or without notice, if:
- You violate any provision of these Terms.
- You engage in activity that is harmful to other users, third parties, or the Service.
- Your account has been inactive for more than 12 consecutive months on the Free plan.
- We are required to do so by law or regulation.
11.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. Provisions that by their nature should survive termination will continue in effect, including sections on intellectual property, limitation of liability, indemnification, and governing law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Sift, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Content you upload, transmit, or otherwise make available through the Service.
- Your use of AI-generated content in communications with leads or third parties.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Sift and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months immediately preceding the event giving rise to the claim.
- For users on the Free plan, our total aggregate liability shall not exceed $50 USD.
- These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We specifically disclaim:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, completeness, or reliability of AI-generated content.
- Any warranty that the Service will meet your specific requirements or expectations.
- Any warranty regarding the results obtained from the use of the Service.
15. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations under these Terms caused by circumstances beyond their reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet or telecommunications failures, or failures of third-party service providers (including OpenAI, Twilio, PayPal, Supabase, and hosting providers).
16. Governing Law & Disputes
- These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
- Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation for a period of 30 days.
- If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
- Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
17. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sift regarding the Service, superseding any prior agreements.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your rights under them without our written consent. We may assign our rights and obligations under these Terms without restriction.
- No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Sift.
- Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
- Notices: We may provide notices to you via email to the address associated with your account or through the Service. You may provide notices to us at the contact information below.
